Abstract
Talaq-Ul-Biddat which is one of the types of Talaq in Muslim law causes hardship and injustice to Muslim women. The Muslim Woman (Protection of Rights on Marriage) Act, 2019 has been passed by Parliament of India which bans Talaq-Ul-Biddat, declares it void if pronounced by husband and provides punishment for it. The criminalization of Talaq-Ul-Biddat is criticized by certain fraction of Muslim community and other scholars in the field of law. This paper aims to find out whether Talaq-Ul-Biddat may be criminalized, after analyzing the new law from Jurisprudential, Constitutional, Legal and other aspects.
